services and website. By accessing our site, you agree to comply with these terms to ensure
a secure and transparent experience.
STANDARD TERMS & CONDITIONS – Mary Kutter
01. Definitions
“Mary Kutter” or “Artist” refers to Mary Kutter, trading under the domain marykutter.com.
“Buyer” refers to any individual, company, or entity purchasing tickets, merchandise, music, or booking Mary Kutter for performances or related services.
“Services” refers to live performances, songwriting, recording sessions, coaching, and any other services provided by the Artist.
“Goods” refers to physical or digital products including, but not limited to, merchandise, music downloads, and other content offered for sale by the Artist.
02. Basis of Agreement
- 2.1 These Terms constitute the entire agreement between the Artist and the Buyer.
- 2.2 By purchasing tickets, merchandise, music, or booking any Services, the Buyer agrees to these Terms, which override any alternative terms proposed by the Buyer.
03. Payments
- 3.1 All prices are quoted in United States Dollars (USD) unless otherwise stated.
- 3.2 Payment in full is required at the time of purchase or booking, unless otherwise agreed in writing.
- 3.3 All tickets, bookings, and digital downloads are non-refundable unless explicitly stated otherwise.
- 3.4 Accepted payment methods include credit/debit card, PayPal, and other approved payment gateways.
- 3.5 In cases of late payment for Services, the Artist reserves the right to cancel the booking without refund.
04. Bookings & Cancellations (Live Performances / Services)
- 4.1 All booking requests must be made in writing via info@marykutter.com.
- 4.2 A booking is confirmed only upon receipt of a signed agreement and deposit.
- 4.3 Deposits are non-refundable unless the Artist cancels the engagement.
- 4.4 Cancellations by the Buyer made less than 30 days prior to the scheduled event will be charged in full.
- 4.5 The Artist reserves the right to cancel any booking due to illness, safety concerns, or circumstances beyond her control (Force Majeure). In such cases, any deposits or payments will be refunded in full.
05. Merchandise & Digital Products
- 5.1 All merchandise is subject to availability.
- 5.2 Delivery times may vary based on the Buyer’s location. The Artist is not responsible for postal or courier delays.
- 5.3 Digital products are provided for personal, non-commercial use only.
- 5.4 Once downloaded or accessed, digital products are non-refundable.
06. Refund Policy
- Merchandise: Refunds or exchanges are only provided for defective or damaged items. The Buyer must notify the Artist within 7 days of delivery.
- Digital Music & Downloads: No refunds will be issued once the product has been accessed or downloaded.
- Event Tickets & Bookings: Non-refundable except in cases where the Artist cancels the event or service.
07. Intellectual Property
- 7.1 All music, lyrics, images, videos, and other creative works produced by Mary Kutter are protected by copyright law.
- 7.2 The Buyer is prohibited from reproducing, distributing, or using the Artist’s content for commercial purposes without prior written consent.
08. Privacy Policy
- 8.1 The Artist collects limited personal data (such as name, email address, and purchase history) solely for the purposes of fulfilling orders and managing bookings.
- 8.2 Personal data will not be sold or shared with third parties except as necessary for payment processing or to comply with legal obligations.
- 8.3 By making a purchase or booking, the Buyer agrees to receive occasional updates from the Artist. The Buyer may unsubscribe at any time.
09. Warranty & Liability
- 9.1 The Artist makes no guarantees regarding any personal or professional outcomes resulting from the Buyer’s use of her Services or content.
- 9.2 The Artist shall not be liable for any indirect, incidental, or consequential losses arising from events, Services, or purchases.
10. Force Majeure
In the event of circumstances beyond the Artist’s reasonable control (including but not limited to illness, severe weather, or government restrictions) that prevent the fulfillment of Services, the Artist will either reschedule or refund affected payments in full.
11. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be subject to the exclusive jurisdiction of the courts in the Artist’s state of residence.
